Terms and Conditions

1. Acceptance of Terms
By creating an account or otherwise using the ProudlyHuman™ platform (the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, do not create an account or use the Service.
The Service is operated by 23 First Corporation trading as Proudly Human (“we”, “us”, “our”).
2. Description of Service
ProudlyHuman™ is an independent certification body that verifies and labels human-created content. Through the Service you can:
- Submit a work for human-origin certification.
- Pay the applicable certification fee and track the progress of your application.
- Receive and download a ProudlyHuman™ certificate if your application is approved.
3. Account Registration
You must provide an accurate name and a valid email address to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at support@23first.org if you suspect unauthorised access.
4. Marketing Communications
When you create an account, you will be added to the Proudly Human mailing list to receive product updates, certification news and related communications. You can unsubscribe at any time using the one-click unsubscribe link in any marketing email; this will not affect transactional emails required to operate your account.
5. Payments
Certification fees are payable per submitted work and are disclosed before checkout. All payments are processed by Stripe. We do not store your card or bank details. Currency conversion, where applicable, is handled by Stripe at prevailing rates. Fees are non-refundable once a certification assessment has commenced, except where required by law.
6. Identity Verification
For most application types we are required to verify your identity. Identity verification is performed by Persona, which collects and processes the relevant ID information directly under its own terms and privacy policy. We receive only the verification outcome.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. In particular, you agree not to:
- Submit any work for certification that you know was not created by a human in accordance with our published de minimis standards.
- Misrepresent your identity, authorship or rights to a work.
- Use the Service in a way that violates any applicable law or regulation.
- Attempt to interfere with, compromise the integrity or security of, or reverse engineer the Service.
- Use any automated means to access the Service without our prior written permission.
8. Certification Outcomes
Certification decisions are made on the basis of the information you submit and the checks we perform. We reserve the right to refuse, revoke or withdraw a certification if a submission is found to misrepresent authorship or fall outside our published standards. Certification status is provided for informational purposes and may be updated without notice.
9. Intellectual Property
The Service and its contents (excluding works submitted by users) are owned by 23 First Corporation and its licensors and are protected by Australian and international intellectual property laws. The ProudlyHuman™ mark and certification logos may only be used in accordance with the licence granted to certified parties.
10. Termination
You may close your account at any time by contacting support@23first.org. We may suspend or terminate your account if you breach these Terms or if continued provision of the Service to you would expose us to legal or reputational risk.
11. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, or that the certification database is complete or free of inaccuracies.
12. Limitation of Liability
To the fullest extent permitted by law, 23 First Corporation, its affiliates and their respective officers, employees and agents will not be liable for any indirect, special, incidental, consequential or punitive damages arising out of or in connection with your use of, or inability to use, the Service.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria, Australia for any dispute arising out of or in connection with these Terms or the Service.
14. Changes to These Terms
We may modify these Terms from time to time. The date of the most recent update is shown at the top of this page. Material changes will be communicated to account holders by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
